What is the difference between representatives?
- Lawyer vs Attorney: They are the same thing
- Public Defenders/State Appointed Lawyer/Attorney: Youth in Washington state between the ages of 12-17 are provided a state attorney at no cost. Youth and families can choose to hire their own legal representation. People above the age of 18 can apply for a court appointed attorney which is based on income.
- Paid Lawyer/Attorney: A paid representative to support someone in court, usually has a focus in either criminal or civil law. Requires some research from the person to find a lawyer/Attorney that is a good fit.
What is the difference between types of legal matters?
- Civil: Civil law describes the law that pertains to persons, things, and relationships that develop among them such as family, wills, trusts, contracts.
- Criminal: This is the type of law that is concerned with the punishment for those who break the law.
Know Your Rights!
- No matter your age, you have the right to remain silent, you have the right to speak with an attorney prior to making any statements to law enforcement.
- If you are 17 and younger, it is against the law for police to ask you questions without a parent, guardian or attorney present.
- If you are 17 or younger, and being released from detainment, you must be released to a parent or legal guardian.
- If you are under the age of 18, if you are detained, you will be released to a parents or legal guardian and you are entitled to a free lawyer/attorney.
- Youth 12-17 held on a fresh arrest can not be bailed out until they see a Juvenile Court Judge or a Prosecuting Attorney
How to handle yourself if encountering Law Enforcement
- Remain calm and follow the officers instructions
- Keep hands visible at all times
- Put down any items in your hands (i.e., bags, jackets)
- Avoid making quick movements
- Avoid pointing, screaming and/or yelling
